Belgian Court Dismisses eBay Charge

eBay has announced that a Belgian court has dismissed legal complaints from French cosmetics company L’Oreal SA that rise from the sale of counterfeit cosmetics and perfumes on the online auction site.

In a case brought by L’Oréal Group, the Belgian Tribunal de Commerce today exonerated eBay of any wrongdoing.

In a statement, eBay says: “This is the second successful court ruling in a row for eBay, both supporting our view that controlling prices and distribution reduces consumer choice. The litigation of counterfeits against eBay has been exposed as merely a stalking horse. eBay provides a vibrant and trusted marketplace that gives European consumers a good deal. We work to tackle the menace of counterfeit through action and co-operation with rights owners.”

Back to the Future Hoverboard on eBay

The original hoverboard used by Michael J. Fox in Back to the Future 2 is for auction on eBay.

The description says.

“957. Michael J. Fox “Marty Mcfly” hero Mattel hoverboard from Back to the Future Part II & Part III. (Universal Pictures, 1989, 1990) This is one of the hero Mattel Hoverboards used by Michael J. Fox in his most famous role as “Marty McFly” in the Robert Zemeckis classic 80s trilogy, Back to the Future. Two styles of Hoverboard were made for and employed in the film – lightweight boards of styrofoam construction and thick and durable wood-based props – this example is the latter, and is recognized as the best example of all wood Hoverboards to have survived the rigors of filming. The illusion of Michael J. Fox as “Marty McFly” hovering through the air was achieved with practical effects, with actors in rigged harnesses being “flown” via cranes, with special effects taking care of the rest.

Of the two styles of props used in the film – styrofoam and wood – the styrofoam examples in collections today have not held up as well, given the more fragile nature of the material and the abuse they endured in production. Few wood examples have survived, and the collector who obtained this specimen from the prop master chose this for his personal collection as the premiere example of those preserved following the film. It is in used but outstanding condition, and is very rare in that it is entirely complete and intact. Given the wood build and use of metal components, it looks and feels like a “real” prop. This piece has the complete fully functional and rear ballbearing-mounted footpad that rotates 360 degrees, as well as the bottom “magnet plates”. Of the two styles of stickers used for the effects, this prop has the “photoboard”-style sticker affixed. In addition, there is other textured styling and hand painting. This Hoverboard also features the hole in the top, representing where the handlebars were that “Marty” pulled off after borrowing the “toy” from the little girl in the film. $30000 - $50000″

IpAuctions auctioning worldwide biotherapeutic patents

RENO, Nev - IpAuctions, Inc. will auction the worldwide biotherapeutic patents previously owned by Cell Works Inc., a Maryland-based biotech company, and acquired by CellPoint Diagnostics, Inc., based in Mountain View, Calif. These patents primarily consist of organ-targeted drug delivery systems to combat liver disease.

Fifteen major U.S. and worldwide medical patents and applications in three major treatment areas will be auctioned, including one associated with a liver cancer therapeutic drug that has been granted orphan drug status by the Food and Drug Administration (FDA). The orphan drug status designation is given to provide special benefits to encourage development of drugs to treat conditions having a prevalence of less than 200,000 cases in the U.S. The worldwide market for a liver cancer therapeutic is quite large, however, and U.S. orphan drug status includes other possible benefits such as research grants, assistance in negotiating the regulatory process and special tax credits. The IP portfolio currently for sale by IpAuctions consists of a therapeutic platform for a ligand-directed drug delivery system that can target the liver or the renal system for greater specificity and efficacy, with less toxicity to the patient.

The patents and applications in this portfolio describe the use of a ligand-directed drug delivery system. The system consists of a ligand (a carbohydrate that is bound and internalized by a cell/tissue-specific receptor on the cell surface) that serves as a guidance system to direct the delivery of the conjugated drug to the targeted organ, according to information provided by Cell Works Inc. of Maryland, the previous owner of this IP portfolio.
